Ordering Wine
Go to the menu "wines"and you will be directed to our wine shop. Select the different criteria such as Region, Wine producer, colour, type of wine. If you do not specify a choice, you will be given the full list of wines available. By clicking on each wine you will be given full information on our wine and prices. All prices mentioned are exclusive of VAT. At the time of ordering you will find full information on VAT and delivery costs, applicable inside BENELUX, in the information column on the left-hand side of the screen.
The minimum order is for 6 bottles.
Each bottle may be a different wine of your choosing. This will give you the freedom to make up your own box with your favourite wines.
When ordering for more than EURO 300,-- there is no delivery charge within the Netherlands and Belgium. For countries outside the Netherlands and Belgium the delivery charge will be indicated in a separate mail. For all deliveries in Germany we will charge EURO 12,39 per parcel of 6 to 18 bottles. This amount must be added to the final amount indicated. Once you are ready to place your order please click on the 'shopping trolley' in the information column and you will see the complete list of articles you have selected. To pay for the selected items click on 'order the items selected' or continue shopping by clicking on 'continue shopping'
Payment
At ROELVIN you can pay by 4 different methods.
1. When you choose IDEAL (only applicable in the Netherlands) you can pay via your own on-line banking.
2. From 1st July 2003 it is possible to pay by bank transfer between European Union member states at no additional charge. Once you have placed your order, you will receive confirmation by return of our bank details. By using our IBAN and BIC numbers you can transfer the amount in approximately 3 to 4 days. Delivery times quoted in the sales terms apply from the day of receipt of your payment, not from the date of your order.
3. The third payment option is Cash On Delivery (C.O.D.). When you choose C.O.D. there will be an extra charge of 12,95 EUROS, to be added to the final amount indicated.
4. When you choose PayPal you will be able to pay via your PayPal account and this permits you to pay with your credit card. You will receive an e-mail containing our invoice and order confirmation as soon as we have received your bank transfer.
ROELVIN will carry out delivery of your order once your payment has been received in our bank account. You will receive an e-mail containing our invoice and order confirmation as soon as we have received your bank transfer.
Deliveries
For deliveries inside and outside the Netherlands we work with various third parties. If you wish to organise your own delivery, kindly let us know by e-mail at: info@roelvin.eu mentioning also your order number.
GENERAL SALES AND DELIVERY TERMS
Article 1. When these conditions apply.
1.1 Our GENERAL SALES AND DELIVERY TERMS apply to all quotations, contracts or agreements made with ROELVIN.
1.2 Upon placing your purchase order or other form of acceptance with us, you thereby agree to be bound by our GENERAL SALES AND DELIVERY TERMS set forth herein regardless of any provisions that may contained in your purchase order which may be contrary thereto.
1.3 Any non-adherence to our GENERAL SALES AND DELIVERY TERMS shall only apply in specific cases as authorised by ROELVIN.
Article 2. Quotations / agreements
2.1 All quotations prepared by ROELVIN will be valid for a fixed period, after which they shall be no longer binding. ROELVIN reserves the right to change its prices in accordance with local regulations. Such price changes will not affect any orders already placed with ROELVIN and will only apply to new orders placed after such price changes.
2.2 All orders are subject to acceptance by ROELVIN. ROELVIN has the right to refuse your order within ten working days after receipt provided a reason is given in writing.
2.3The contents of any information, file, printed matter, etc., published by ROELVIN shall not be binding, unless explicit reference is made to such contents in the contract.
Article 3. Prices and Payments
3.1 All listed prices are exclusive of Dutch VAT, transport and handling costs and any levies imposed by the Dutch authorities, unless stated otherwise. Any delivery charges or taxes payable will be clearly indicated and included in the total price of your order.
3.2 Payments may be made on-line via Ideal pay (only applicable in the Netherlands), by bank transfer or Cash On Delivery (C.O.D).
3.3 Your order will be delivered upon receipt of the due amount in our bank account or your cash with order. In the event of both parties having agreed on C.O.D terms, if at the time of delivery you are unable to meet your payment obligations, then your order will not be delivered by ROELVIN, and any delivery or other additional costs will be due by you to ROELVIN.
3.4 If payment as mentioned in 3.3 is only partly received, ROELVIN shall reserve the right to either postpone or cancel the agreement between both parties.
Article 4. Deliveries
4.1 The delivery date indicated at the time of your order is to be treated as a best estimate and is not binding on ROELVIN . ROELVIN shall not be liable for any costs incurred due to any delay in shipment, nor will you have the right to cancel the agreement unless ROELVIN is not able to deliver your order within 30 days, in which case you have the right to cancel the agreement at no extra cost. ROELVIN will inform you within 30 days of receipt of your order should such a situation arise and shall refund any payments received to your bank account.
4.2 Delivery charges within the Netherlands and Belgium are as follows : Euro 8,50 excl. VAT for delivery of orders up to Euro 300,-- to each address, or F.O.C. for delivery of orders over Euro 300,--
4.3 Delivery in the Netherlands and in Belgium is approximately 10 days from receipt of your payment.
4.4 Delivery outside Netherlands and Belgium will be treated separately, ROELVIN will contact you after the order to agree on your preferred method of transport and payment. For all deliveries in Germany we will charge EURO 12,39 per parcel of 6 to 18 bottles.
Article 5. Ownership of the goods
5.1 Goods delivered by ROELVIN shall remain the property of ROELVIN until you have paid the full amount due according to the agreement. Any risk regarding the use of these goods will be transferred to you, the customer, upon delivery to the specified delivery address.
Article 6. Complaints, return shipments
6.1 Upon delivery of your order, you must report any visible defects or omissions immediately to ROELVIN in writing.
6.2 If the wine delivered to you is not up to your expectations, you may either return the wine to us and we shall replace it with another wine, or you may request a complete refund. Complaints will only be valid if a maximum of 2 bottles have been tasted.
6.3 If for any reason you do not wish to keep your order, you may return the product within 7 days to ROELVIN. However, return shipments shall only be accepted if the original packing remains undamaged and the packing tape still sealed. Any costs incurred to return the goods will be your responsibility. Any amounts already paid to ROELVIN will be completely refunded within 30 days. Purchase of goods is however considered binding within 7 days from delivery of the goods at the delivery address specified.
Article 7. Force majeure.
7.1.Failure by ROELVIN to carry out the Contract shall be regarded as force majeure if it cannot be attributed to any fault on the part of ROELVIN or is outside of ROELVIN?s control As such ROELVIN will not be liable for any costs incurred due to such failure, in accordance with the Contract and generally accepted standards and regulations.
7.2 The term ?force majeure? shall in any case be understood to mean:
* strike action;
* interruptions in transport;
* government action preventing ROELVIN from fulfilling its obligations in a timely or proper manner;
* lack of materials or other goods or services required to perform the agreed service;
* unexpected illness.
7.3 Any obligation on the part of ROELVIN will not be binding during a period of force majeure. If service is delayed due to force majeure, ROELVIN shall be entitled to dissolve the Contract with no obligation to provide compensation for any loss incurred unless common sense would show it reasonable to do so.
Article 8. Various.
8.1 If you confirm in writing an address in one of the countries covered by our service, ROELVIN will send all orders to the address specified, unless you specify in writing a different delivery address.
8.2 Whilst ROELVIN's general sales and delivery terms will at all times be binding upon the customer, ROELVIN itself , if necessay, will have the right to deviate from such terms without prejudice.
8.3 ROELVIN has the right to use third parties to carry out its orders and deliveries.
Article 9. Applicable law, Disputes.
9.1 All rights, obligations, quotations, orders and agreements in relation to our GENERAL SALES AND DELIVERY TERMS are governed by Dutch law. The buyer can obtain the original Dutch version and the translation into English of these Terms upon request. In the event of possible disputes, the original Dutch version shall be binding.
9.2 Shoud you not be satisfied with a product or service, please contact us as soon as possible, preferably by e-mail to: info@roelvin.eu. We will reply to any complaint within 30 days.
9.3 Should still no agreement be reached, upon payment of a fee of 25 Euro, you may lodge a formal complaint with the Geschillencommissie Thuiswinkel, Postbus 90600, 2509 LP Den Haag. For more information regarding the Geschillencommissien (complaint commission) please visit: www.sgc.nl This independent commission will provide a judgement regarding your complaint, and their final judgement will be binding. Should the commission make a judgement either entirely or partly in your favour, you will receive a full or part- refund accordingly of the original fee paid of the 25 Euro.
9.4 Despite the aforementioned, you may in any case and without restriction lodge your complaint at an appropriate court of law.
